Florida’s Department of Financial Services describes UM as coverage for accidental bodily injury, sickness, disease or death when an at-fault motorist has no bodily injury liability coverage or insufficient limits. Florida law can also treat a vehicle as uninsured in certain situations, including when its insurer cannot pay because of insolvency or when its bodily injury limits are insufficient in relation to the covered damages. Whether UM applies depends on the policy, signed forms and claim facts.
Is uninsured motorist coverage required in Florida?
UM is not one of the two basic coverages generally required to register an applicable four-wheel vehicle in Florida. Those requirements include at least $10,000 in Personal Injury Protection and $10,000 in property-damage liability.
Florida Statute §627.727 creates a separate rule. When a motor vehicle liability policy provides bodily injury liability for a specifically insured vehicle registered or principally garaged in Florida, the policy generally must include UM. The named insured may reject it in writing or select lower limits on an approved form.
Without a valid lower-limit selection, UM limits generally may not be lower than the bodily injury liability limits purchased. A prior written rejection or lower-limit selection may continue at renewal or replacement when the bodily injury limits stay the same, so do not assume an earlier decision automatically resets each year.
